Terms of Service

These Terms of Service (“Terms”) govern your use of the Rentouri platform operated by Damian Gadomski, a sole trader (Jednoosobowa Działalność Gospodarcza) registered in Poland under NIP: PL5213819318, address: ul. Zamiany 8/LU202, 02-786 Warszawa (“Rentouri”, “we”, “us”). By registering an account or using our services, you agree to these Terms in full. If you do not agree, do not use the platform.

Part A — General Terms

1. Definitions

  • Platform — rentouri.com, app.rentouri.com, and all related services
  • Guest — a user who searches for and books rental equipment through the marketplace
  • Shop — a rental business registered on app.rentouri.com (ERP platform)
  • Booking — a confirmed reservation of equipment from a Shop by a Guest
  • Marketplace Booking — a Booking initiated and paid online through rentouri.com
  • Walk-in Booking — a Booking created by Shop staff at the counter without online payment

2. Platform Role — We Are an Intermediary

Rentouri is a technology platform that connects Guests with rental Shops. Rentouri is not a party to the rental contract between a Guest and a Shop. The rental agreement is concluded directly between the Guest and the Shop when a Booking is confirmed.

Rentouri facilitates booking and payment processing, and enforces these Terms. Rentouri does not inspect equipment and does not verify Shop insurance — it relies on the Shop’s warranty in Section 16. Rentouri is not responsible for: the condition or safety of equipment; the accuracy of shop listings; or a Shop’s failure to fulfil a Booking.

3. Accounts

You must provide accurate, complete information when registering. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to create an account. Creating an account — on the marketplace or in the shop portal — constitutes acceptance of these Terms; the acceptance is recorded together with its timestamp and the Terms version in force. Rentouri reserves the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You must not:

  • Use the platform for any unlawful purpose
  • Circumvent platform payments — for example by arranging bookings or payments directly with a Shop outside of Rentouri
  • Scrape, copy, or distribute platform content without written permission
  • Impersonate another user or provide false identity information
  • Attempt to reverse-engineer, disrupt, or interfere with platform operations

5. Intellectual Property

All platform content — design, copy, software, data — is owned by Rentouri or its licensors. Nothing in these Terms grants you any rights in that content beyond the right to use the platform as intended. You may not copy, reproduce, or distribute platform content without prior written permission from Rentouri.

6. Limitation of Liability

To the maximum extent permitted by Polish law:

  • Rentouri's total liability for any claim arising from use of the platform shall not exceed the total fees you paid to Rentouri in the 3 months preceding the claim.
  • Rentouri is not liable for: damage or injury caused by rental equipment; a Shop's failure to honour a confirmed Booking; losses arising from platform downtime or errors; or indirect, consequential, or punitive damages.

These limitations do not apply to: death or personal injury caused by Rentouri’s own negligence; fraud or fraudulent misrepresentation; or any liability that cannot be limited or excluded under mandatory Polish or EU consumer protection law.

7. Governing Law and Disputes

These Terms are governed by the law of the Republic of Poland. Any dispute arising from these Terms shall be subject to the jurisdiction of the competent court in Warszawa, Poland.

EU consumers: If you are a consumer resident in the EU, you retain the right to bring proceedings before the courts of your country of residence and to rely on mandatory consumer protection provisions of your local law. You may also be able to use out-of-court complaint and alternative dispute resolution (ADR) procedures available in your country of residence.

8. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 14 days’ notice to registered users by email. Continued use of the platform after the notice period constitutes acceptance of the revised Terms. If you do not accept a change, you may close your account before the change takes effect.

Part B — Guest Terms

9. The Booking Process

To make a Marketplace Booking:

  • Search for a Shop by destination, dates, and sport type
  • Choose the exact equipment you want — the model and, where applicable, the size — from the Shop's inventory
  • Review your selection and the Shop's cancellation policy
  • Sign the Shop's rental agreement electronically, then complete payment through Stripe

A Booking is confirmed when payment is successfully processed and you receive a confirmation email. The model and size you selected are guaranteed — at pickup the Shop hands you a physical unit of that exact model and size, and may not substitute different equipment without your agreement. The rental agreement you sign is concluded directly with the Shop (see Section 2).

Request to book: some Shops review requests before accepting them. For those Bookings your card is authorised (a hold is placed) but not charged at checkout. You are charged only when the Shop accepts your request; if the Shop declines, or does not respond within approximately 7 days, the hold is released and you are not charged.

10. Payments and Damage Deposits

All Marketplace Booking payments are processed by Stripe. You must provide a valid payment method at checkout. Where applicable, a refundable damage deposit is pre-authorised (held but not charged) on your card when you complete your booking. The deposit is released automatically — typically within 7 days — after your equipment is returned in good condition as confirmed by the Shop.

You are always charged in the Shop's own currency, which is shown at checkout. If you browse in a different currency, converted prices are approximate and shown for convenience only — any currency conversion is performed by your card issuer, which may apply its own exchange rate and fees.

Damage waiver: some Shops offer an optional damage waiver for an additional fee shown at checkout. If you take it, the Shop waives or reduces the damage claims and/or damage deposit it would otherwise apply, on the waiver terms shown at checkout and in the rental agreement. A damage waiver is not an insurance product and does not insure you or the equipment.

11. Cancellations and Refunds

Each Shop sets its own cancellation policy, which is prominently displayed on the Shop’s listing page and during checkout before you pay. Rentouri enforces the Shop’s stated policy on their behalf.

If a Shop cancels a confirmed Booking, you are entitled to a full refund of all amounts paid, including any commission. Rentouri will process this refund within 5–10 business days.

Damage deposits are not affected by cancellation — they are released automatically when no damage claim is made.

12. Equipment Use and Your Responsibility

You are responsible for using rented equipment appropriately and following the Shop’s usage instructions. You must return equipment in the same condition as when received, fair wear and tear excepted. You are liable for damage caused by:

  • Misuse or negligent handling of the equipment
  • Use of the equipment in conditions or activities it was not designed for
  • Failure to report pre-existing damage at the time of pickup

13. Identity Verification

Before completing your first Booking, you may be required to verify your identity through Stripe Identity. This is required as part of our fraud prevention obligations. Verification is a one-time step and does not affect subsequent bookings.

14. Consumer Rights

If you are a consumer resident in the EU, you have statutory rights under the Consumer Rights Directive (2011/83/EU) and applicable national law that cannot be excluded or limited by these Terms. Nothing in these Terms is intended to, or shall, restrict your statutory consumer rights.

Part C — Shop Owner Terms

15. Eligibility to Register as a Shop

To register as a Shop on Rentouri, you must:

  • Be a legally registered business entity within the EU
  • Hold valid public liability insurance with a minimum coverage of €1,000,000 per occurrence
  • Complete Stripe Connect Express onboarding (bank account verification + KYC)
  • Have your account approved by Rentouri before appearing in the marketplace

16. Insurance and Equipment Safety — Shop Warranty

By listing on Rentouri you continuously warrant, for as long as your Shop is on the platform, that:

  • You hold valid public liability insurance with a minimum coverage of €1,000,000 per occurrence;
  • Your rental equipment is maintained in accordance with manufacturer standards and undergoes regular safety inspections;
  • You immediately withdraw from rental any equipment that is unsafe or defective.

Rentouri does not verify these matters in advance and relies on this warranty. Rentouri may request proof of insurance at any time; failure to provide it within 7 days may result in suspension of your Shop. A breach of this warranty is a material breach of these Terms.

Rentouri is not responsible for any claim arising from inadequate or lapsed Shop insurance or from ill-maintained equipment. As an independent business, you bear sole responsibility for injuries or damage caused by your equipment or staff, and you will indemnify Rentouri against third-party claims arising from a breach of this warranty.

17. Subscription Plans and Billing

Rentouri offers the following subscription plans:

  • Prices are exclusive of applicable VAT
  • Plans are billed in advance (monthly or annually, your choice)
  • No minimum contract period — cancel anytime
  • Cancellation takes effect at the end of the current billing period
  • No partial refunds for unused subscription time
  • Rentouri may change plan pricing with 30 days' notice to existing subscribers

18. Commission

Commission applies only to Marketplace Bookings — online bookings from Guests who discovered your Shop on rentouri.com. Walk-in bookings (cash or your own payment terminal) are always commission-free.

  • Commission is calculated on the Guest-facing total (after any discounts applied)
  • Commission is deducted from your payout at the time the booking payment is processed
  • The exact rate within your plan's range is determined by booking volume and confirmed at the time of your subscription
  • Commission rates are guaranteed for the duration of your current billing cycle and subject to 30 days' notice for changes

19. Payouts

Payouts are processed via Stripe Connect. Stripe’s standard settlement schedule applies — typically T+2 to T+7 business days, depending on your country and bank. Rentouri may withhold payouts in cases of: active payment disputes or chargebacks; suspected fraud; or a booking under investigation.

20. Stripe Connected Account Agreement

By registering as a Shop, you agree to the Stripe Connected Account Agreement. Rentouri creates and manages a Stripe Express account on your behalf. You complete identity verification and banking details through Stripe’s secure hosted onboarding. Rentouri retains the right to update your connected account and manage disputes centrally as permitted under the Stripe Connect Express model.

21. Listing Obligations

You must ensure that:

  • All listed equipment is accurately described (type, condition, size range)
  • Equipment is maintained in a safe and functional condition at all times
  • All confirmed Bookings are honoured — repeated cancellations by the Shop may result in account suspension
  • Availability is kept up to date in the ERP system
  • Pricing displayed on Rentouri matches the actual price charged to Guests

22. Guest Data — Your Obligations

You receive limited Guest booking data (name, phone number, dates, equipment assignment) solely to fulfil the specific rental. You must:

  • Use the data only for fulfilling the rental — not for any marketing or other purpose
  • Not contact Guests via channels outside the Rentouri platform
  • Not solicit off-platform bookings from Guests introduced through Rentouri
  • Delete received Guest data when no longer required for the booking or applicable legal retention obligations
  • Maintain appropriate technical and organisational security measures for the data you hold

You are an independent data controller for Guest data you receive and bear responsibility for your own GDPR compliance regarding that data.

23. Termination

Either party may terminate the Shop’s subscription with 30 days’ written notice.

Rentouri may terminate immediately, without notice, if you:

  • Commit fraud or provide false information
  • Repeatedly fail to honour confirmed Bookings
  • Allow your liability insurance to lapse without prompt renewal
  • Materially breach any provision of these Terms
  • Engage in discriminatory conduct toward Guests

Upon termination: your Shop listing is removed from the marketplace; in-progress Bookings are handled as agreed; pending payouts for fully completed Bookings are settled according to Stripe’s normal schedule.

24. Shop Liability

As an independent business, you are solely liable for: the safety and condition of your rental equipment (per your warranty in Section 16); any injuries or property damage caused by your equipment or staff; compliance with all applicable local, national, and EU regulations; and fulfilling statutory consumer rights obligations to your Guests directly. You will indemnify Rentouri against third-party claims for injury or property damage arising from your equipment or its maintenance.

Rentouri’s liability to you as a Shop is limited to the subscription fees paid in the 3 months preceding any claim. Rentouri is not liable for loss of bookings, revenue, or profit resulting from platform downtime, technical errors, or search ranking changes.
